行政法是由三个Temple Chambers的Barristers讲的，每个人讲三节，前三节的老师是資深大律師（SC），他已经是SC，所以还是很牛逼的。不过他的讲课还是不敢恭维，首先是没有PPT，其次就是讲课就是直接照着给我们的资料念，念到一些需要注意的地方，停下来解释一下，没什么系统性，我记笔记也很不方便。
这第一节课也是讲一些基础的知识，比如行政法的概念和目的，什么是Judicial Review,什么情况下适用 Judicial Review，笔记也记不得不是很多，反正之前给的材料很多，但是因为这周课程实在太密集了，上午刚上完刑法，完全[……]
Seminar 1 (Jan 20, 2018)
这学期的合同法还是R来上，他在课上说这学期是他在HKU的最后一个学期，不知道他是要退休了，还是出去继续做法官去了。他在课上也说，希望班上的人能多几个考虑以后做Barrister，应该现在香港法官严重缺乏，而香港和其他普通法地区一样，法官基本都要在职业律师队伍中寻找，因为香港的律师分Barrister和Solicitor，前者的前几年比较难混，所以导致很多人都选择做Solicitor，导致一心想做Bar的人并不多，进一步导致法官也很紧缺。其实我也想做Bar，但是前几年真是没有信心挺过来。

这节课还是女大律师讲的，主题是Irrationality，要读的东西还是很多，加上案例公16个之多，这学期的课程就行政法的阅读多，每节课三个小时，我得花一天半的时间准备。Irrationality和Illegality 不一样，Illegality是指政府的行为已经超出了法律允许的范围，即越权了，但是因为法律赋予政府的很多权力都是有很大的自主裁量空间，所以在不少案例中，政府的行为其实并没有越权，即其实是合法的，但是即便如此，法院也可能介入，介入的一个重要的理由就是Irrationality，即即使政府的行为没有越权，但是如果其行政决定是i[……]

今天叶老师竟然迟到了，我像往常一样，11点去食堂吃完饭，一顿狼吞虎咽，最快也得11点15分才能吃完，然后快马加鞭地美心食堂奔向法学院楼，快到电梯时，看到前面走着的一个人的背影不就是叶大妈吗？然后到了电梯口，果然是她，我还礼貌地向她一笑，她也微微一笑，然后就没有然后了，继续这么尴尬地等电梯。等电梯到了之后，发现里面站满了人，有几个如往常一般也是班里的人，都是著名的迟到专业户，包括那个法国小哥。我上学期还是挺上进的，一般都提前十分钟就去了，但是这学期我也加入了迟到专业户的行列。

Reading week之后的第一节Tort课，这节讲的是Defamation（诽谤或者造谣），其实这也是个没有定论的问题，因为处理这个问题也会面临与言论自由权的冲突，不过相比上一节的Harassment，倒也没那么纠结了，毕竟有比较清晰的结构和处理方式，比如要构成Defamation，需要满足三个要素：
